                                                                RETURNS & REFUNDS POLICY

This Returns & Refunds Policy applies to Goods supplied by Shamber Pty Ltd ABN 87 169 618 660 trading as MobiGo Distributors (MobiGo, we, us or our). MobiGo primarily supplies wholesale and business customers. 

This Policy should be read together with MobiGo's Terms & Conditions of Trade. Nothing in this Policy excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL) or other applicable law. 

1. Change-of-Mind Returns 

MobiGo is not required to provide a refund, credit or exchange where a Customer simply changes its mind, orders the wrong product or quantity, finds the Goods cheaper elsewhere, no longer requires the Goods, or is unable to resell them. 

MobiGo may, at its discretion, approve a commercial change-of-mind return. Approval must be obtained before Goods are returned. 

If approved, MobiGo may require the Goods to be: 

  • unopened and unused; 

  • in their original packaging; 

  • undamaged and in saleable condition; 

  • complete with all accessories, instructions and components; and 

  • accompanied by acceptable proof of purchase. 

Approved voluntary returns may be subject to reasonable return freight, handling or restocking charges where disclosed and permitted by law. 

2. Incorrect, Short or Damaged Deliveries 

Customers should inspect Goods promptly after delivery. 

If an Order contains an incorrect product, a shortage or visible transport damage, please notify MobiGo as soon as reasonably practicable and preferably within 48 hours of delivery. This timeframe helps us investigate the issue with our warehouse or carrier; it does not remove any rights that cannot lawfully be excluded. 

Please provide, where relevant: 

  • the invoice or Order number; 

  • the product name or item code; 

  • the quantity affected; 

  • a description of the issue; 

  • clear photographs of the Goods, packaging and shipping label; and 

  • any other information reasonably requested to investigate the claim. 

Where MobiGo confirms that Goods were incorrectly supplied, short supplied or damaged before risk passed to the Customer, MobiGo will provide an appropriate remedy, which may include replacement, supply of the missing Goods, account credit or refund, subject to applicable law and the circumstances of the claim. 

3. Faulty Goods 

If Goods appear faulty or defective, contact MobiGo before returning them. We may request photographs, video, batch or serial information, details of the fault and information about how the Goods were stored, installed or used. 

MobiGo may reasonably inspect or arrange assessment of the Goods before determining the appropriate remedy, provided this does not limit a remedy available under applicable law. 

A remedy may not be available where the problem was caused by misuse, accidental damage, improper storage, unauthorised modification, failure to follow manufacturer instructions, normal wear and tear, or another cause for which MobiGo is not legally responsible. 

4. Australian Consumer Law 

Where the Australian Consumer Law applies to a transaction, Goods come with consumer guarantees that cannot be excluded by this Policy. 

Depending on the circumstances, a business purchaser may be a 'consumer' for ACL purposes. However, consumer guarantees generally do not apply to Goods acquired for the purpose of resupply or for using or transforming them in production or manufacture in the circumstances specified by the ACL. 

Where Goods fail to meet an applicable consumer guarantee, the remedy depends on the nature and seriousness of the failure. For a major failure, the consumer may have rights including rejecting the Goods and choosing a refund or replacement, subject to the ACL. For a failure that is not major, the supplier may generally choose to provide an appropriate remedy within a reasonable time. 

Nothing in this Policy is intended to replace or reduce rights available under the ACL. 

5. Proof of Purchase 

MobiGo may require reasonable proof that the Goods were purchased from us. Acceptable proof may include a MobiGo invoice, Order confirmation, account transaction record or other evidence that reasonably demonstrates the purchase. 

Customers should quote their invoice or Order number when contacting us about a return, refund or credit. 

6. Return Authorisation 

Unless required otherwise by law, Goods must not be returned to MobiGo without prior return approval. 

If a return is approved, MobiGo may provide return instructions or a return authorisation reference. The Customer must follow those instructions so the return can be identified and processed correctly. 

Sending Goods back without approval does not guarantee that MobiGo will accept the return, issue a credit or pay return freight. 

7. Return Freight 

Where Goods are returned because MobiGo supplied the wrong Goods, the Goods are faulty and MobiGo is responsible for the remedy, or MobiGo is otherwise required by law to bear the return cost, MobiGo will arrange or reimburse reasonable return freight as appropriate. 

For discretionary change-of-mind or other commercial returns approved by MobiGo, the Customer is generally responsible for return freight unless MobiGo agrees otherwise in writing. 

Goods should be securely packaged for return. The Customer may be responsible for loss or damage occurring because Goods were inadequately packaged for a voluntary return. 

8. Special Orders, Clearance and Custom Goods 

Special Orders, Goods specifically sourced or imported for a Customer, customised Goods, discontinued Goods and clearance Goods are generally not eligible for change-of-mind returns. 

This exclusion does not apply where a return, refund or other remedy is required by applicable law, including where relevant consumer guarantees apply. 

9. Credits and Refunds 

Where a return or claim is approved, MobiGo may issue the remedy required or agreed in the circumstances, which may include replacement Goods, repair, account credit or refund. 

For trade customers, approved commercial returns may be credited to the Customer's MobiGo account unless a refund is required by law or MobiGo agrees to another method. 

Where a refund is issued, MobiGo will generally refund using the original payment method where reasonably practicable. Processing times may vary depending on the payment provider or financial institution. 

10. Manufacturer Warranties 

Some Goods may also be covered by a manufacturer's warranty. Manufacturer warranties are additional to any rights that apply under Australian law and do not replace rights that cannot lawfully be excluded. 

MobiGo may ask for information reasonably required by a manufacturer to assess a warranty claim. Where appropriate, we may assist the Customer to progress the claim with the manufacturer or supplier. 

11. Goods Purchased for Resale 

MobiGo primarily supplies wholesale Goods that Customers may acquire for resale. The availability of statutory consumer guarantees to the purchasing business depends on the circumstances and the ACL. 

Regardless of whether the ACL consumer guarantees apply to a particular wholesale purchase, MobiGo will investigate genuine claims involving Goods that were incorrectly supplied, damaged before risk passed, or otherwise supplied contrary to MobiGo's contractual obligations. 

12. Product Recalls and Safety Issues 

Where Goods are subject to a product recall or safety notice, Customers should follow the instructions issued by MobiGo, the manufacturer, supplier or relevant regulator. 

Customers should promptly stop sale or use of affected Goods where directed and cooperate with reasonable recall, quarantine, return or customer-notification requirements. 

13. How to Request a Return or Refund 

To request a return, refund, credit or replacement, contact MobiGo Distributors using the current contact details published on our website. 

Please include your business name, invoice or Order number, affected product, quantity, reason for the request and supporting photographs or other evidence where relevant.

MobiGo may update this Policy from time to time. The current version will be published on the MobiGo Distributors website with its effective or last-updated date. 

This Policy forms part of MobiGo's customer-service policies and should be read together with the Terms & Conditions of Trade, Privacy Policy and Shipping & Delivery Policy.
